Terms of Use

The short version. Use Spēk to talk with people, in your own voice and no one else's. Translation is very good but not perfect, so do not rely on it alone where a mistake could hurt someone. Subscriptions renew until you cancel them in your app store. You can stop using Spēk and delete everything at any time.

By using Spēk, on the web or in the app, you agree to these terms, to our Community rules and to our Privacy Policy.

Who can use Spēk

You must be at least 13 years old to use Spēk.
You must be 18 or older to record and clone your voice, and to use Spēk Romance.
If you use Spēk on behalf of a company, you agree to these terms for that company.

Your voice

Record and clone your own voice only, after reading and accepting the consent screen yourself.
Your voice is used only to speak your own translated words in Spēk. You can delete it at any time with Voices → Forget voice, or by deleting your account.
Do not use Spēk to impersonate anyone, or to make it sound as if a real person said something they did not say.

What you say

What you say and write in Spēk stays yours. You give us permission to process it, which means transcribing, translating, voicing and delivering it, only to run Spēk for you and the people you talk with, as described in the Privacy Policy.
You are responsible for what you say through Spēk. The Community rules say what is not allowed, and how to report or block someone.

Translation is a help, not a guarantee

Spēk uses speech recognition and AI translation. It can mishear, mistranslate or miss tone. Do not rely on Spēk alone for medical, legal, financial, safety or emergency matters. In those situations, confirm what was meant with the other person, or use a professional interpreter.

Free use, Spēk Plus and purchases

Free: conversations with a stock voice, and your own voice for a daily allowance. After the allowance, your words are spoken by your phone's built-in voice. We may change the free allowance, and we will say so in the app.
Spēk Plus is an auto-renewing subscription, monthly or yearly, bought through the App Store or Google Play. The price is shown before you buy. It renews automatically at the end of each period unless you cancel at least 24 hours before, in your App Store or Google Play subscription settings. Refunds are handled by Apple or Google under their rules.
Founders Circle and other purchases on our website are processed by our payment processor. The terms shown at checkout apply.
In the App Store app, Apple's standard end-user licence agreement also applies.

Fair use

Do not try to break, overload, scrape or reverse-engineer Spēk, or to get around the daily allowance or our limits.
Do not use Spēk to make recordings or translations for resale, or to build a competing service.
Apps and websites may link to Spēk using our public links (see For developers). Linking does not make them part of Spēk, and it does not give them access to anyone's data.

Stopping, and when we may stop you

You can stop using Spēk at any time and delete your account in Profile → Delete my account, or at spek2me.com/delete-account.
We may suspend or remove an account that breaks these terms or the Community rules, as the rules describe.
Spēk is new and will change. We may add, change or remove features. If we ever close Spēk, we will give notice in the app and by email where we have it.

Our responsibility

Spēk is provided "as is" and "as available". We work hard to keep it running and accurate, but we cannot promise that it will always be available, error-free or right in every translation. As far as the law allows, ArtemisWorx LLC is not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing in these terms limits rights you have under the consumer law of the country where you live that cannot be limited by contract.

Law

These terms are governed by the laws of the State of New Hampshire, USA, except where the law of the country where you live requires otherwise. If a part of these terms cannot be enforced, the rest still applies.

Changes

If we change these terms in a way that matters, we will say so in the app or by email before the change takes effect. The date at the top shows the current version.
